PROCEDURE FOR ACCESSING CONFIDENTIAL INFORMATION

The user may at any time submit a request to access the personal data stored about them in the Company’s database, provided they state their full name and present an identification document. The user’s request for stored personal data is fulfilled free of charge. There is no delay in satisfying the user’s request to access their personal data, except in cases where the confidential information cannot be provided within 30 calendar days from the date of the request. In such cases, the Company must fulfill the user’s request within no more than 45 calendar days. The user must be informed in writing about the delay, along with an explanation of the procedure for challenging the Company’s decision regarding the delay.
In the case of refusal or delay in responding to a request for access to personal data, the user may appeal the Company’s decision by contacting the Ukrainian Parliament Commissioner for Human Rights or through the courts.
Before filing a court claim regarding a personal data dispute, the user must submit a complaint (a written proposal for voluntary settlement of the dispute).
The Company has the right to respond to the user’s complaint within 30 calendar days from the date of receipt. The response regarding the complaint review and the Company’s decision will be provided to the user in writing.
If the dispute cannot be resolved amicably, it shall be considered in court in accordance with the provisions of current Ukrainian legislation.
RIGHTS OF THE PERSONAL DATA SUBJECT
The personal data subject (user) has the rights defined by the Law of Ukraine “On the Protection of Personal Data”. These rights include:
- to know the sources collecting personal data, as well as the location of these sources and the databases;
- to obtain information about the conditions and procedures for accessing personal data from these sources, as well as to be informed of third parties to whom the data is or may be transferred;
- to access personal information no later than 30 days after submitting a request to the source, or no later than 45 days in cases defined by law;
- to demand that any data source stop collecting and processing the user’s personal data and refrain from further disclosure;
- to demand that any data source amend or delete the user’s personal data if it is inaccurate or obtained/processed unlawfully;
- to protect their personal data from security violations such as unlawful processing, accidental loss, destruction, damage, concealment, or dissemination of false or defamatory information;
- to file a complaint with the Ukrainian Parliament Commissioner for Human Rights or the courts regarding unlawful processing of their personal data;
- to impose their own conditions for personal data processing at the time of giving consent for data processing;
- to withdraw their consent to the storage and processing of personal data at any time;
- to be informed about the principles and methods of automated processing of personal data.
